These Terms and Conditions ("Terms") govern your use of the Tap & Bloom website, applications, and services (the "Services"). By accessing or using the Services, you agree to be bound by these Terms.

If you do not agree, you must not use the Services.

1. About Tap & Bloom

Tap & Bloom provides a digital memory creation and reveal service that allows users to upload media (such as photos, videos, and messages) and share them via a digital experience.

Tap & Bloom may update or modify the Services at any time.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.

3. User Accounts and Guest Use

You may use the Services as a guest or create an account.

  • Guest users may later create an account and claim eligible purchases where sufficient matching information is available

  • You are responsible for maintaining the confidentiality of your account credentials

  • You are responsible for all activity under your account or linked contact details

4. Purchases and Pricing

  • Products are digital and priced as displayed at checkout (currently £0.99 unless otherwise stated)

  • Payment must be made in full before delivery

  • Tap & Bloom reserves the right to change pricing at any time

5. Delivery of Services

A product is considered delivered when:

  • The memory experience has been successfully created, and

  • The reveal link has been generated and made available to the purchaser or sent to the intended recipient

Delivery does not depend on whether the recipient opens or views the memory.

6. Refunds

Due to the nature of digital products:

Refunds may be provided only where:

  • A proven technical failure occurs

  • Duplicate charges are made

  • No usable memory is delivered

  • A material service failure prevents access and cannot be resolved in a reasonable time

Refunds will NOT be provided for:

  • Change of mind

  • Dissatisfaction with content or experience

  • Recipient not opening the link

  • Incorrect recipient details provided by the user

  • Link sharing or misuse after delivery

  • Successfully delivered and accessible memories

7. User Content and Ownership

You retain ownership of any content you upload.

By using the Services, you grant Tap & Bloom a limited, non-exclusive, worldwide, royalty-free license to:

  • Host, store, process, format, and transmit content

  • Display and deliver content to intended recipients

  • Maintain backups, troubleshoot, and secure the system

  • Improve and operate the Services

  • Comply with legal obligations

This license is limited to what is necessary to provide the Services.

8. Content Editing, Deletion, and Access

  • You may edit or delete content before purchase or sending

  • After purchase or sending, editing is not guaranteed unless explicitly supported

  • Deletion after purchase is subject to system functionality and retention policies

  • Download/export is only available where explicitly provided

9. Acceptable Use

You must not upload or share content that:

  • Is illegal or infringes rights

  • Contains abusive, hateful, explicit, or harmful material

  • Violates privacy or consent

  • Contains malware or harmful code

  • Impersonates others or is deceptive

Tap & Bloom may remove content, restrict access, or take enforcement action without notice.

10. Access and Sharing

  • Memory reveals are accessible via a link and may be accessed multiple times during availability

  • Links may be shared by recipients

  • Tap & Bloom does not guarantee control over further sharing

  • Users are responsible for entering correct recipient details

Tap & Bloom is not responsible for:

  • Incorrect delivery due to user error

  • Access by unintended recipients

  • Sharing or misuse after delivery

11. Storage and Availability

  • Draft content may be stored temporarily (e.g. up to 1 day)

  • Purchased memories are available for a limited time (e.g. up to 183 days)

  • Content may be deleted after expiry or under system rules

Deleted or expired content is not guaranteed to be recoverable.

12. Technical Limitations

  • Upload limits apply (e.g. max 3 media items, max 1 video)

  • Supported file formats and sizes may vary

  • Tap & Bloom does not guarantee uptime or delivery timing

  • The Services are provided using commercially reasonable efforts

13. Liability

To the fullest extent permitted by law:

  • Tap & Bloom is not responsible for:

    • User errors (including incorrect recipient details)

    • Link sharing or misuse

    • Emotional dissatisfaction

    • Loss of content outside our control

    • Device, browser, network, or third-party issues

Tap & Bloom’s total liability is limited to the amount paid for the affected product.

Nothing in these Terms excludes liability that cannot be excluded under law.

14. Intellectual Property

Tap & Bloom owns or licenses all rights in:

  • The platform, software, and infrastructure

  • Branding, trademarks, and designs

  • System workflows and user experience

You may not:

  • Copy, reproduce, or distribute the platform

  • Reverse engineer or modify the system

  • Use the Services for commercial exploitation without permission

15. Suspension and Termination

Tap & Bloom may suspend or terminate access at any time where necessary, including for:

  • Breach of these Terms

  • Fraud or abuse

  • Legal or security risks

  • Misuse of the Services

Access may be restricted immediately without notice.

16. Data Handling After Termination

After termination:

  • Access to the Services may be removed

  • Content may be deleted in accordance with retention policies

  • Tap & Bloom may retain limited data for legal, security, or operational purposes

17. Changes to the Services and Terms

We may update the Services or these Terms at any time. Continued use of the Services constitutes acceptance of any updates.

18. Governing Law

These Terms are governed by the laws of England and Wales.
